Wills

Its a document that sets out your instructions for assets after you die. It is so important that only a 'wet' signature is acceptable, that means on paper with a pen, with witnesses to your signing that document who also sign to attest to the witnessing.

When you die your total assets get renamed as your Estate, The terms 'will writing' and 'estate planning' are often used interchangeably. 'estate planning incorporates a will as the 'cornerstone' and often it is sufficient to satisfy the intentions of the donor.

Trusts

A trust in this context is an agreement between a person wishing to leave a legacy (the Donor) to a Beneficiary with oversight of a Trustee a person with legal responsibility to ensure the condition of the trust are fulfilled.

Lasting Powers of Attorney (LPA)

Born of the Mental Capacity Act 2005 which brought with it a whole new set of rules through a Code of Practice for the professional dealing with clients who are considered vulnerable including the elderly, and those at risk and in danger of abuse and for individuals who lack mental capacity.

An LPA is probably the most important document a person can put in place during their lifetime. The Person known as the Donor appoints one or more Attorneys to make decisions on their behalf should they lose the capacity to make them themselves.
